Luna Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Luna ('the App'), developed by Studio Phoenix, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you must not use the App.

2. Description of Service

Luna is a period and hormonal health tracking application. The App allows you to:

• Log menstrual cycles, symptoms, mood, sleep quality, energy levels, and other health-related data
• Add notes via text or voice input and attach photos to log entries
• View cycle predictions and phase estimates based on your logged data
• Export your data as CSV files or generate PDF health reports
• Access educational content about reproductive and hormonal health
• Optionally sync your data across devices via Cloud Sync (Premium subscription feature)

The App is designed as an informational and personal tracking tool only.

3. Not Medical Advice

Luna does not provide medical advice, diagnosis, or treatment.

• Educational content within the App is for informational purposes only and should not replace professional medical guidance
• Always consult a qualified healthcare provider for medical decisions
• Luna must not be used as a contraceptive method, fertility planning tool, or fertility treatment tool. Cycle predictions and fertile window estimates are statistical approximations based on the data you provide. They do not account for individual biological variation and may not be accurate
• Phase estimates (menstrual, follicular, ovulatory, luteal) are calculated from general cycle models and may not reflect your actual hormonal state
• PDF health reports generated by the App are summaries of user-entered data and do not constitute medical records or clinical assessments

4. Use of the App

You agree to:

• Use the App only for lawful purposes and in accordance with these Terms
• Maintain the security of your device and the data stored within the App
• Not attempt to reverse engineer, decompile, modify, or impair the App's functionality
• Accept responsibility for the accuracy of the data you enter into the App
• Not use the App to store data on behalf of other individuals without their knowledge and consent

5. Accounts and Cloud Sync

5a. Local-Only Use (No Account Required)

Luna does not require you to create an account or provide any personal information to use the App. There is no registration, login, or authentication process required for core features. The App is available for immediate use upon installation.

5b. Cloud Sync (Optional, Premium Feature)

If you subscribe to Luna Premium and choose to enable Cloud Sync:

• You will need to create an account using a valid email address
• You are responsible for maintaining the confidentiality of your account credentials
• You must notify us promptly at support@studiophoenix.io if you suspect unauthorised access to your account
• You can disable Cloud Sync at any time and continue using the App in local-only mode
• You can request deletion of your account and all cloud-stored data at any time

6. Data Storage and Privacy

Your use of Luna is also governed by our Privacy Policy. Key points include:

• By default, all data you create within the App is stored locally on your device only
• When Cloud Sync is enabled, your data is encrypted and stored securely on our servers to enable cross-device access
• The App does not use analytics, crash reporting, or any form of data tracking
• In local-only mode, you are solely responsible for backing up your data; if you uninstall the App or your device is lost, damaged, or reset, your data cannot be recovered by Studio Phoenix
• When Cloud Sync is enabled, your data can be restored by signing in on a new device

7. Subscriptions and In-App Purchases

Luna is free to download and use with core features available at no cost. Premium features, including Cloud Sync, are available through a paid subscription.

Subscription Terms

• Subscriptions are billed on a recurring monthly basis through the respective app store (Google Play Store or Apple App Store)
• Your subscription will automatically renew unless you cancel at least 24 hours before the end of the current billing period
• You can manage or cancel your subscription at any time through your app store account settings
• Refunds are handled in accordance with the policies of the app store through which you made the purchase
• We reserve the right to change subscription pricing with reasonable notice. Price changes will not affect your current billing period
• If your subscription expires or is cancelled, you retain access to all core features and your locally stored data. Cloud Sync will be disabled, but any previously synced data on your device remains accessible

Payment Processing

All payment transactions are processed entirely by the app store. Studio Phoenix does not collect, process, or store any payment information, billing details, or financial data.

8. User Content

Regarding content created using Luna:

• You retain all rights to your health data, cycle logs, symptom records, photos, notes, and any other content you create within the App
• You are solely responsible for the accuracy of all information entered into the App
• You may export your data at any time via the App's CSV export or PDF report features
• When you share exported data (via email, messaging, or other means), you are responsible for the privacy and security of that data once it leaves the App

9. Educational Content

Luna includes educational articles, glossary terms, and informational content about reproductive and hormonal health. This content:

• Is for educational and informational purposes only
• Is not a substitute for professional medical advice, diagnosis, or treatment
• May be updated, modified, or removed at any time without notice
• Should be verified with a qualified healthcare provider before making health decisions

10. Device Permissions

Luna may request access to certain device features to provide its full functionality:

• Notifications: Used solely to deliver cycle and health reminder notifications that you configure within the App
• Microphone: Used for voice-to-text input when logging symptoms and notes. Speech recognition is processed on your device; no audio is sent to external servers
• Photo Library: Used to select images from your photo library to attach to cycle log entries. Images remain stored locally on your device
• Storage Access (Android): Used to save exported PDF reports to your chosen location on your device

All permissions are optional and used only for the purposes described above. The App does not send marketing, promotional, or any other type of notification. The App does not access your camera directly.

11. Intellectual Property

Luna and its original content, features, and functionality are owned by Studio Phoenix and are protected by international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of the App's content without prior written consent from Studio Phoenix.

12. Limitation of Liability

To the maximum extent permitted by law:

• The App is provided 'as is' and 'as available' without warranties of any kind, whether express or implied
• Studio Phoenix is not liable for any indirect, incidental, special, or consequential damages arising from your use of the App
• We do not guarantee the App will be error-free or uninterrupted
• We are not responsible for data loss due to device malfunction, loss, theft, app uninstallation, or user error
• Cycle predictions, fertile window estimates, and phase calculations are statistical approximations only. We are not responsible for any consequences arising from reliance on these predictions, including but not limited to unplanned pregnancy or failed conception attempts
• Health and educational content within the App is for informational purposes only. We are not responsible for any health decisions made based on this content
• The App is a personal health tracking tool; it is not a substitute for professional medical advice, diagnosis, or treatment

13. Termination

By You

You may terminate your use of the App at any time by uninstalling it from your device. Upon uninstallation, all locally stored data will be permanently deleted. If you have an active subscription, you must cancel it separately through your app store account settings to avoid continued billing. If you have a Cloud Sync account, you may request deletion of your cloud-stored data by contacting us at support@studiophoenix.io.

Studio Phoenix reserves the right to discontinue the App or remove it from app stores at any time. In such cases, we will provide reasonable notice where possible and allow users to export their data. We may suspend or terminate Cloud Sync accounts that violate these Terms.

14. Changes to These Terms

We may update these Terms of Service from time to time. Changes will be reflected by updating the effective date at the top of this page. For material changes, we will provide notice through the App or via email (for Cloud Sync users) at least 14 days before the changes take effect. Your continued use of Luna after changes constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of New Zealand, without regard to conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of New Zealand.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary while the remaining provisions remain in full force and effect.
