Audit Base Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Audit Base ('the App'), developed by Studio Phoenix, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you must not use the App.

2. Description of Service

Audit Base is a field audit and inspection reporting application for contractors, safety inspectors, and property managers. The App allows you to:

• Create audits and capture photo-based evidence, issue records, and notes against each finding
• Organise findings by project, site, and inspection
• Generate branded PDF reports and share them from your device
• Work offline and continue capturing audits without a connection
• Optionally back up and sync your data across devices via Cloud Sync

The App is a documentation and reporting tool only. You are responsible for the accuracy of every audit and report you produce with it.

3. Use of the App

You agree to:

• Use the App only for lawful purposes and in accordance with these Terms
• Maintain the security of your device and the data stored within the App
• Not attempt to reverse engineer, decompile, modify, or impair the App's functionality
• Accept responsibility for the accuracy, completeness, and legality of the audits and reports you create
• Ensure you have the necessary rights and permissions to photograph and document any site, property, or person captured in your reports

4. Accounts and Cloud Sync

4a. Local-Only Use

Audit Base can be used without an account. Core auditing and PDF report features are available immediately upon installation, and your data is stored locally on your device.

4b. Cloud Sync (Optional)

If you choose to create an account and enable Cloud Sync:

• You will need to register using a valid email address
• You are responsible for maintaining the confidentiality of your account credentials
• You must notify us promptly at support@studiophoenix.io if you suspect unauthorised access to your account
• You can disable Cloud Sync at any time and continue using the App in local-only mode
• You can request deletion of your account and all cloud-stored data at any time

5. Data Storage and Privacy

Your use of Audit Base is also governed by our Privacy Policy. Key points include:

• By default, audits, photos, and reports you create are stored locally on your device
• When Cloud Sync is enabled, your data is encrypted and stored securely on our servers to enable cross-device access and backup
• In local-only mode you are solely responsible for backing up your data; if you uninstall the App or your device is lost, damaged, or reset, your data cannot be recovered by Studio Phoenix
• When Cloud Sync is enabled, your data can be restored by signing in on a new device

6. In-App Purchases

Audit Base is free to download with core features available at no cost. Additional features may be offered through optional in-app purchases. Key details:

• All purchases are processed through the respective app store (Google Play Store or Apple App Store)
• Refunds are handled in accordance with the policies of the app store through which you made the purchase
• Studio Phoenix does not collect, process, or store any payment or billing information
• We reserve the right to change pricing with reasonable notice

7. User Content

Regarding content created using Audit Base:

• You retain all rights to the audits, photos, notes, and PDF reports you create within the App
• You are solely responsible for the accuracy and legality of all information recorded in your audits and reports
• You warrant that you have the right to capture and store any photographs, location data, and site details included in your reports

8. Device Permissions

Audit Base may request access to certain device features to provide its functionality:

• Camera and photo library: Used to capture and attach photo evidence to your audit findings
• File storage: Used to save and export PDF reports to your device
• Notifications: Used to deliver reminders you configure within the App

These permissions are optional and used only for the purposes described above.

9. Reports Are Not Certified Inspections

Audit Base is a documentation tool and does not provide professional, engineering, safety, or legal advice. PDF reports generated by the App are summaries of the information you enter and the photos you capture. They do not constitute a certified, accredited, or independent inspection, and they are not a substitute for a qualified professional assessment. You are responsible for ensuring your audits and reporting practices comply with all applicable standards, regulations, and obligations.

10. Intellectual Property

Audit Base and its original content, features, report templates, and functionality are owned by Studio Phoenix and are protected by international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of the App's content without prior written consent from Studio Phoenix.

11. Limitation of Liability

To the maximum extent permitted by law:

• The App is provided 'as is' and 'as available' without warranties of any kind
• Studio Phoenix is not liable for any indirect, incidental, special, or consequential damages arising from your use of the App
• We do not guarantee the App will be error-free or uninterrupted
• We are not responsible for data loss due to device malfunction, loss, theft, app uninstallation, or user error
• We are not responsible for any decisions, actions, or omissions made on the basis of audits or reports created with the App

12. Termination

You may terminate your use of the App at any time by uninstalling it from your device. Upon uninstallation, all locally stored data will be permanently deleted. If you have a Cloud Sync account, you may request deletion of your cloud-stored data by contacting us at support@studiophoenix.io. Studio Phoenix reserves the right to discontinue the App or remove it from app stores at any time without prior notice.

13. Changes to These Terms

We may update these Terms of Service from time to time. Changes will be reflected by updating the effective date at the top of this page. Your continued use of Audit Base after changes constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of New Zealand, without regard to conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of New Zealand.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary while the remaining provisions remain in full force and effect.
